The guests discussed issues surrounding the flag burning cases, U.S. v. Haggerty and U.S. v. Eichman. These cases force the Court to consider the constitutionality of the Flag Protection Act of 1989, which mandates fines and imprisonment for those who “knowingly” mutilate or physically defile the flag of the United States. The Flag Act of 1989 came in reaction to last year’s decision in Texas v. Johnson which held that laws prohibiting flag-burning violate the First Amendment’s free speech clause. close
