Witnesses testified about proposed changes to Real Estate Settlement Procedures Act regulations. Although a number of changes were proposed, the most contentious issue was a rule that would allow mortgage lenders to bundle the loan with mortgage settlement and other services. Supporters of the rule argued that, by permitting lenders to offer a complete mortgage package, the rule would simplify the process for borrowers. Opponents expressed concern that the rule would prevent consumers from searching for the best price on each service, and that packaging services would allow large lenders to drive small mortgage services firms out of business, decreasing competition and ultimately increasing the price paid by consumers. Some witnesses and members of the committee also criticized the rule-making process, claiming that supporting evidence and analysis were lacking and that the secretive nature of the process did not allow adequate public scrutiny and input.
