The Ninth Circuit Court of Appeals head oral arguments in the case of Nordyke v. King et al. in which gun show operators Russell and Sallie Nordyke appealed a ban of firearms from the Alameda County Fairgrounds that did not except gun shows. Mary King was one of the members of the Alamed County Board of Supervisors named in the suite. The plaintiffs contended that the ban violates their First Amendment right of free speech and their Second Amendment right to bear arms, as well as the due process clause as other groups were allowed to have guns on the fairgrounds. The plaintiffs also argued that the individual right to bear arms recognized by the U.S. Supreme Court in District of Columbia v. Heller must be recognized by states and not just the federal government under the 14th Amendment.
