The Supreme Court heard oral argument in the case Department of Homeland Security v. MacLean, docket number 13-894. At issue was whether whistle-blower protection extends to unauthorized disclosure of sensitive security information. Air Marshal Robert MacLean was fired for telling a reporter that the Transportation Security Administration (TSA) canceled missions on commercials flights that required marshals to stay overnight. Mr. MacLean’s supervisor told him that the cancellations were to save money. Believing that the TSA action risked passenger safety, he leaked the information to an MSNBC reporter, prompting congressional criticism and leading to the TSA’s reversal of its decision.

The court on January 21, 2015, ruled that Congress did not intend for the disclosure exception in the Whistleblower Protection Act (WPA) to apply to disclosures prohibited by regulation because Congress used the phrase, “law, rule, or regulation” as exceptions in other places in the WPA. close
