A panel discussion was held on the Emancipation Proclamation as a legal document. Frank Williams talked about the legal background of President Lincoln in the years before he was elected to the presidency. Kurt Schmoke spoke about the constitutional basis that President Lincoln used in creating the Emancipation Proclamation. He said that the Proclamation set a precedent for the expansion of executive power due to it functioning outside of the strict interpretation of Article Two of the Constitution and would previously have been perceived as only existing within the boundaries of Congressional legislative authority.
“Abraham Lincoln, Lawyer in the White House: the Emancipation Proclamation as a Legal Document” was the third panel on the second day of the conference on “Race and Emancipation in the Age of Lincoln,” held as part of the national commemoration of the 200th anniversary of President Abraham Lincoln’s birth. Howard University hosted the conference co-sponsored by the Abraham Lincoln Bicentennial Commission (ALBC).
