Professor Cole discussed several constitutional law cases to be taken up by the Supreme Court this term. U.S. v. X-Citement Video is a child pornography case in which a California statute would make persons criminally liable for distributing pornographic materials, even when they did not know the persons depicted were minors. However, the main issue is whether or not the California Court of Appeals read the statute correctly. Professor Cole will be arguing in Lebron v. National Railroad Passenger Corporation on the side of Lebron. The issue is whether National Railroad (Amtrack) is a government entity subject to First Amendment restrictions. Lebron was prevented from posting a political advertisement in an Amtrack station. In Bentsen v. Adolph Coors Coors company is challenging a post-Prohibition federal statute which bans beer manufacturers from placing the alcohol content of beer on the container label. In U.S. v.
