Mr. DeGioia and Mr. Traynor gave opening remarks at a conference titled “Fair and Independent Courts: A Conference on the State of the Judiciary.” Former Supreme Court Associate Justice Sandra Day O’Connor spoke about the importance of an independent judiciary. She talked about criticisms of the court for containing “judicial activists,” the role of judicial review in the American system, and concepts of constitutional government.
Her remarks were followed by a panel discussion titled “Judicial Independence: Justifications and Modern Criticisms.” Panelists talked about judicial review within the federal court system, limits placed on branches of government by the U.S. Constitution, enforcement of judicial decisions, and the history of the U.S. judicial system. They also responded to questions from the audience.
Several sitting justices and prominent legal scholars were among members of the audience.
