Judith Conti talked about the practice among some employers of excluding unemployed workers from their applicant pool through explicit or implicit language in job postings. The New York City Council passed a bill forbidding employers from basing hiring decisions on applicants' unemployment status, and from posting job advertisements that require applicants to be employed. President Obama introduced similar federal legislation, as have congressional Democrats. Ms. Conti addressed some of the reasons for this practice, difficulties in proving discrimination, and other topics. She also responded to telephone calls and electronic communications.
