The case, J.E.B. v. T.B. examined whether gender-based jury selection violates the Equal Protection Clause of the 14th Amendment to the Constitution. Outside the courthouse, Lois Brasfield discussed the use of peremptory challenges in jury selection and indicated that it is difficult to avoid discrimination and stereotypes in eliminating jurors. She spoke in favor of litigants using peremptory challenges on whatever basis they choose. Marcia Greenberger stated that gender was not a legitimate basis for eliminating jurors. close
