The Federalist Society held a conference to discuss the role of courts in separation of powers disputes. Solicitor General Starr moderated the panel discussion. Starr gave a brief review of the judicial role in separation of powers disputes. Professor Stephen Carter focused on disputes between the courts and another branch of the Federal government. He criticized the Supreme Court’s recent application of judicial review in the cases of Morrison v. Olson and Mistretta v. United States.
