The guests discussed Cheney v. U.S. District Court for the District of Columbia. The case stemmed from an effort to use the Federal Advisory Committee Act to force the release of the records of Vice President Cheney’s energy task force. The question of jurisdiction was also raised. The Supreme Court would hear oral arguments in the case on Tuesday April 27. Tom Fitton argued that the records should be made public, while John Duffy supported the government’s position that the records should not be released.
