Participants spoke to reporters on the steps of the U.S. Supreme Court following oral arguments in the case of Caperton v. A.T. Massey Coal Company. Former Solicitor General Theodore Olson was representing Hugh Caperton, president of Harman Mining Corporation. Andrew Frey was representing Don Blankenship of Massey Energy.
The Court would decide whether a judge’s failure to recuse himself from a case in which he received substantial campaign donations from one of the parties violates the Due Process rights of the other party. The case resulted from the refusal of acting West Virginia Chief Justice Brent Benjamin to recuse himself from a multimillion-dollar appeal involving his major campaign contributor, Don Blankenship, chairman and chief executive officer of Massey Energy Co.
