The U.S. Supreme Court heard oral argument on Fisher v. University of Texas at Austin, docket number 11-345, a case on affirmative action policies in higher education.

Justice Kagan did not take part in the case.

The Supreme Court decided 7-1 to send the case back to the Fifth Circuit Court of Appeals for further review. Justice Kennedy in his opinion for the Court wrote that the university’s program must be narrowly tailored enough “to prove race-neutral alternatives would not produce the "educational benefits of diversity.” Justice Ginsburg dissented. close
