Harold Koh testified that the War Powers Act of 1973 did not apply to U.S. involvement in Libya and that President Obama did not need congressional authority for continued support of the NATO mission to protect the Libyan opposition forces. Several committee members strongly disagreed, including Ranking Member Dick Lugar (R-IN) who called the move a “fundamental failure of leadership” and one that lacked constitutional discipline.
