Panelists discussed federalism cases that will come before the Supreme Court in the current term. First, Professor Chermerinsky discussed the effects that past federalism cases have had, including a narrowing of Congress' powers, a reviving of the 10th Amendment as a limit of federal power, and the expansion of state sovereign immunity. Some of the cases the panelists discussed included Nevada Department of Human Resources v. Hibbs, Pharmaceutical Manufacturers Association v. Concannon and Pierce County v. Guillen.
