Nebraska Attorney General Donald Stenberg and Simon Heller, who represented Dr. Leroy Carhart, argued whether a Nebraska statute violated the liberty protected by due process of the Fourteenth Amendment of the U.S. Constitution. The Nebraska law prohibited any partial birth abortion unless the procedure was necessary to save the mother’s life.
