Supreme Court Review

Cases discussed: The following highlights from the 23 cases handed down by the Court this week are discussed: [Texas v. Johnson] involved the Court's decision to strike down a Texas law prohibiting desecration of the American flag. Stakeout footage of activity around the Court the day the decision was announced is also included. [Public Citizen v. U.S. Justice Dept.] deals with the Court's decision to restrict the power of the American Bar Assn. in evaluating judges nominated to federal positions. The Court overturned a federal law outlawing dial-a-porn services in [Sable Communications v. FCC] by ruling that the statute violated constitutional protections of indecent speech. Other issues discussed are the upcoming abortion decision and the decision to uphold a law allowing prosecutors to freeze the assets of drug dealers, consequently limiting their ability to obtain counsel.

Supreme Court Review

Cases discussed: The Court's decision on [Patterson v. McLean Credit Union] is analyzed. The case involved the right of Ms. Patterson to sue on the basis of racial harassment on the job. The Court reversed its 1976 [Runyon v. McCrary] decision by saying that the 1966 Civil Rights Act does not apply to harassment on the job. In [Maratin v. Wilkes], white firefighters in Birmingham, AL claimed reverse discrimination in hiring and promotion. The firefighters sought to overturn a consent agreement made by the city to hire more blacks. The Court, citing Sixth Amendment rights to a day in court, ruled that the white firefighters could sue to overturn the consent agreement.

Supreme Court Review

Cases discussed: [Wilkins v. Missouri] and [Stanford v. Kentucky] are discussed as examples of numerous cases before the court relating to the death penalty for juveniles issue. The role of the most recent court appointee, Anthony Kennedy, is analyzed, as is the performance of Chief Justice William Rehnquist. Oral arguments in [Patterson v. McClean Credit Union] are analyzed in light of a possible reversal of [Runyon v. McCrary], a previous civil rights case. At issue is the right of a person to sue private individuals in the event of racial harassment. Also, journalists interview Mr. Morris, Ms. McKerrow, Mr. Cowan and Mr. Heft. Footage is taken from the morning (3/27) of the oral arguments in the juvenile death penalty cases.

Supreme Court Review

Cases discussed: The focus is on [Hustler Magazine, Inc. v. Falwell]. The Court faces the question of whether Rev. Jerry Falwell should be awarded damages for a parody in Hustler that he claims constituted "intentional infliction of emotional distress." Additional discussion topics: Larry Flynt's previous appearances before the Court; the seriousness of the ruling for the media; the theatrical nature of the oral arguments in the Court and in the interviews held outside the Supreme Court building. The [Karcher v. May] case is also briefly discussed. It involves New Jersey's "moment of silence" statute, which requires a one minute moment of silence in all public schools for introspection or reflection.
