      <description>Grover Norquist and Laura Murphy talked about potential changes to the Electronic Communications Privacy Act (ECPA), which governs government access to information stored on the Internet. They argued that the government could read emails without a warrant, and that privacy rules on the Internet were far looser than those that apply to the postal service or telephone use.
The two guests came together to support changing the ECPA, and also to launch the Digital 4th, a group "dedicated to bringing Fourth Amendment protections into the 21st century."</description>

      <title>Privacy in the Digital Age</title>
      <description>Panelists talked about how new technologies have outpaced traditional privacy safeguards and what the possibilities are for updating the Electronic Communications Privacy Act (ECPA) and other electronic surveillance laws. In their discussion they concentrated on electronic mail and cell phones. They agree that changes were needed to address technology and national security threats but that any reforms should also protect civil liberties.

Ms. Toensing argued that the new provisions were necessary in order to prevent terrorism and resolve certain legal issues and technicalities. Ms. Murphy argued that the Justice Department and other law enforcement entities acted opportunistically to secure passage of the Patriot Act in the wake of September 11, and that many of the provisions circumvented judicial oversight and were not necessary to prevent terrorism.
