Campaign Finance and [Citizens United] Decision

Political scholars examined the consequences of the Supreme Court's [[Citizens United v. Federal Election Commission] decision and its impact on elections and politics. Former Election Commission Chairman Bradley Smith defended Citizens United ruling that allows corporations to spend unlimited money on elections, but he also addressed the need to restore political party's significance in the campaigns. The panel also discussed what policy changes should be enacted in future elections. Notable speakers included former White House Counsel Robert Bauer and former federal election commission chairman Bradley Smith.
This was the first panel of a Cato Institute forum on the Supreme Court's Citizens United v. Federal Election Commission decision.

Judicial Nominations in 2011

White House Counsel Robert Bauer spoke about the Obama administration's judicial nominees and the confirmation process. He noted a number of stalling tactics that Senators had used to slow or stop the confirmation process. While he said that this tactic had been used by both Republicans and Democrats, judicial vacancies have reached a point where the federal justice system was suffering and justice was not being served. Following his remarks panelists focused on the impact of judicial vacancies, delays in confirmations, and the quality of nominees.

[Citizens United v. Federal Election Commission] Preview

Panelists discussed upcoming the Supreme Court case [Citizens United v. Federal Election Commission] (FEC). The case stems from a lower court case appeal in which the United States District Court for the District of Columbia sided with the FEC that [Hillary: The Movie] could not be shown on television right before the 2008 Democratic primaries under the McCain-Feingold Act. The ruling could change a century-long precedent that allows the government to ban corporations from spending money to support political candidates. This case was originally heard by the Court in March 2009. The Court asked the attorneys involved to provide additional briefs and rescheduled this case before the start of the term. It wwould be Justice Sonia Sotomayor's first oral argument at the Supreme Court, and Solicitor General Elena Kagan's first time arguing before the Court.

Topics included history of the case and other related cases. Joan Bikupic moderated. Following their discussion, panelists responded to questions from members of the audience at the National Press Club.

Three panels appeared before the Senate Rules Committee to address concerns over enforcement of campaign finance law. Senators McCain and Feingold testified on what they see as an unwillingness of the Federal Election Commission to enforce campaign finance law, and discussed reforming the commission. A panel of attorneys then testified about possible reforms to the commission, including altering the number of commissioners from even to odd in order to prevent tied votes.
