Book Discussion on [David's Hammer]

Constitutional lawyer Clint Bolick talked about his book, [David's Hammer: The Case for an Activist Judiciary], published by the Cato Institute. He made the argument that an activist judicial branch is essential in order to keep the executive and legislative branches from becoming too powerful and threatening individuals' constitutional rights. For example, he says the judiciary should protect school choice and property rights, so that they are not compromised by the other branches of government. He was joined in discussion by M. Edward Whelan III, and Jeffrey Rosen. Mr. Rosen is the author of [The Supreme Court: The Personalities and Rivalries that Defined America]. After their presentations the three men responded to audience members' question.

Interstate and Internet Wine Sales

Guests talked about interstate and Internet wine sales. The following Tuesday the Supreme Court was scheduled to hear a case to decide whether wineries may sell and ship wine across state lines. The three consolidated cases involved state laws in New York and Michigan that allow only in-state wineries to ship wine to consumers within its borders. Out-of-state wineries were currently required to ship through wholesalers. They also responded to telephone calls, faxes, and electronic mail from viewers.

Wine Shipping Debate

The panelists talked about and debated state laws regulating the shipment and importation of alcoholic beverages. The specific issue addressed was the internet sale and subsequent interstate shipment of wine directly from wineries to consumers. Supporters of the state provisions argued that the Twenty-first Amendment to the Constitution granted states the right to regulate the importation of wine and other alcoholic beverages. Opponents of the state provisions claimed that bans on direct interstate shipment of alcoholic beverages unfairly and unreasonably restrained trade, were designed to protect local monopolies and oligopolies, and infringed on the constitutionally enumerated power of Congress to regulate interstate commerce. Following prepared remarks, panelists responded to questions from the audience.

The speakers gave their report on Assistant Attorney General Lee's work in the area of civil rights. Mr. Bolick said that Mr. Lee was never confirmed by the Senate and that he advanced an extreme ideological agenda. He stated that Mr. Lee has used the resources of the civil rights division to pursue racial preferences in government contracting, employment and education. Mr. Clegg commented that the Senate cannot confirm Mr. Lee because he shredds the constitution if the Senate wants to uphold the constitution. He said that he hopes that President Clinton will not nominate Mr. Lee again for the post of Assistant Attorney General. They took questions from reporters.

Nightline: Friday

Nightline reports an intense saga within a local high school in New Jersey. It was back in 1989 when the community school board had to lay off one of two teachers. Each one was nearly equally qualified; however, one was black and the other teacher was white. So the school board decided to base its decision on race. They fired the white teacher, Sharon Taxman. Just recently, affirmative action decided to take a blow after 30 years of promoting women and minorities. Taxman, with the help of Bush administration lawyers filed suit in federal court that the board discharged her based on race in violation of the civil right law. The Federal Court of Appeals decided to settle.
