[Hollingsworth v. Perry] Oral Argument Reaction

Following oral argument before the U.S. Supreme Court in the case of [Hollingsworth v. Perry], lawyers for the petitioners spoke to reporters and answered questions on the steps of the Court. The petitioners were the proponents of the ballot initiative known as Proposition 8, which banned same-sex marriage in California.

[Hollingsworth v. Perry] Oral Arguments

The Supreme Court heard arguments in [Hollingsworth v. Perry] on the constitutionality of California's proposition 8 law. Nearly 18,000 same-sex couples were married in California, but same-sex marriages came to a halt in November 2008, when the state's voters passed Proposition 8, which amended the state constitution to eliminate the right of same-sex couples to get married. Questions by several justices focused on whether the central purpose of marriage was procreation, and on whether proponents of the ban had legal standing to bring the case after the state of California declined to do so when the referendum result was overturned by a federal court.

Judicial Tenure and the Supreme Court

Panelists spoke about the concept of life tenure for justices of the Supreme Court of the United States instead of a fixed term of years or a mandatory retirement age. No other western democracy and only one of the fifty states has life tenure for its supreme court. Issues included the fact that life expectancy has greatly increased since the Constitution was written and therefore vacancies occur much less frequently than in previous years. Judge Wilkinson moderated.

Government Secrecy: What Does Congress Need to Know?

Television producer Lear, the founder of People for the American Way, discussed the purpose of the organization. Ornstein served as moderator of the panel discussion. The thesis put to the panel was that there had been an explosion of secrecy in recent years. Scowcroft said it is not something new, but that the Reagan administration had become secretive because it was especially "leaky." Rep. Hamilton, who was chairman of the House Iran- Contra committee, said that there had been a sharp increase in the number of covert operations and the amount of the "black budget" in addition to increased numbers of secret documents. The panel discussed the growth in secrecy being a result of a growing struggle between the executive and legislative branches. Much of the discussion centered around the Iran-Contra affair. Rep. Hamilton commented on the need for policies to be made "through the process," even if covert operations in support of the policy need to be carried out secretly.
