      <title>Title IX and the Supreme Court</title>
      <description>The guests debated the implementation of Title IX, the law that prohibits sex discrimination in education. Ms. Schlafly participated from St. Louis. They responded to audience telephone calls, faxes and electronic mail. 
 
 On November 30 the U.S. Supreme Court will hear oral arguments in [Jackson v. Birmingham Board of Education] in which Coach Roderick Jackson of Ensley High School in Birmingham, Alabama was stripped of his coaching duties for protesting the unequal treatment of his girls' basketball team. The Supreme Court will decide whether those who are penalized for protesting sex discrimination can go to court to challenge the retaliation to which they are subjected. The National Women's Law Center is representing Mr. Jackson in this case. The Eagle Forum has filed a brief opposing his efforts.</description>

The senators and speakers from other groups asserted that refusal of cloture was a victory for women and minorities. However, the Justice Department brought suit against Virginia for supporting the Virginia Military Institute with public funds. Virginia has countered with its own suit that this court's decision was unconstitutional.</description>

Outside the courthouse, Ms. Brasfield discussed the use of peremptory challenges in jury selection and indicated that it is difficult to avoid discrimination and stereotypes in eliminating jurors. She was in favor of litigants using peremptory challenges on whatever basis they choose. Ms. Greenberger stated that gender is not a legitimate basis for eliminating jurors.</description>
