Supreme Court Term Review

Supreme Court reporters reviewed the 2011-12 term. Among the topics they covered were the consistency of the justices on First Amendment issues, rulings against the government in life sentences for juveniles, allowing police to track someone by global positioning systems, and plea bargaining cases. They discussed the Affordable Care Act ruling, the health care law, at length. Of Chief Justice Roberts' vote on health care, David Savage said, "...eight of the nine voted as you would have guessed.... Only one justice voted in a way that you wouldn't have guessed....It seems to me the last person you ought to say that made a decision that's political is John Roberts."

[Citizens United v. Federal Election Commission] Preview

Panelists discussed upcoming the Supreme Court case [Citizens United v. Federal Election Commission] (FEC). The case stems from a lower court case appeal in which the United States District Court for the District of Columbia sided with the FEC that [Hillary: The Movie] could not be shown on television right before the 2008 Democratic primaries under the McCain-Feingold Act. The ruling could change a century-long precedent that allows the government to ban corporations from spending money to support political candidates. This case was originally heard by the Court in March 2009. The Court asked the attorneys involved to provide additional briefs and rescheduled this case before the start of the term. It wwould be Justice Sonia Sotomayor's first oral argument at the Supreme Court, and Solicitor General Elena Kagan's first time arguing before the Court.

Topics included history of the case and other related cases. Joan Bikupic moderated. Following their discussion, panelists responded to questions from members of the audience at the National Press Club.

Moot Court: [Rumsfeld v. FAIR]

The Institute of Bill of Rights Law, part of the William and Mary School of Law, marked the commencement of the new term of the United States Supreme Court with its 18th annual Supreme Court Preview conference. The Supreme Court Preview brought together leading court journalists, advocates, and legal scholars for a day and a half to discuss and analyze the Court's upcoming term.

The first session of the conference featured a moot court argument based on the [Rumsfeld v. FAIR] case, which was about a federal law that requires colleges and universities that receive certain types of federal aid to allow military recruiters on campus. Some universities viewed this as an intrusion into their First Amendment rights because of the "Don't Ask, Don't Tell" policy.

Participants included Jay Sekulow of the American Center for Law and Justice representing Rumsfeld; Beth Brinkman, former Asst. to the Solicitor General in the Clinton Administration, representing FAIR (Forum for Academic & Institutional Rights); and Walter Dellinger, former Acting Solicitor General in the Clinton Administration, with an amicus brief representing Harvard Law School

Representing Supreme Court Justices were Joan Biskupic, Linda Greenhouse, Charles Lane, Michael Gerhardt, David Savage, John Payton, Stuart Taylor, William Van Alstyne, and Dahlia Lithwick.
