Veterans of combat operations in Afghanistan testified about their experiences and offered advice from the perspective of soldiers and junior officers in the field. Most said that U.S. forces had done an insufficient job of reaching out to local villagers and presenting a viable alternative to cooperation with anti-Western fundamentalists.
Witnesses testified about mismanagement at Arlington National Cemetery. According to an Army report, as many as 6,600 graves were misidentified, improperly marked, or indicated personnel were buried in the wrong graves due to bad record keeping. John Metzler in his testimony said he took "full responsibility" for the problems but rebutted some of the findings in the Army report. Thurman Higginbotham left the hearing early after asserting his Fifth Amendment right against self-incrimination in response to several questions.

[Veterans for Common Sense v. Shinseki] Oral Argument

The Ninth Circuit Court of Appeals heard oral argument in [Veterans for Common Sense v. Shinseki]. Veterans for Common Sense, and co-plaintiff Veterans United for Truth, asked the Court to order the Department of Veterans Affairs to reform the way it deals with disability claims for post-traumatic stress disorder and traumatic brain injury. In a suit filed in July 2007 a lower court ruled that the judicial branch does not have the authority to order the VA to provide timely medical care.

[Veterans for Common Sense v. Shinseki], Case # 08-16728, was heard by the Ninth Circuit Court of Appeals at 9:30 a.m. PT on August 12, 2009, in San Francisco. The suit was first filed against Secretary Nicholson, the successively against Secretaries Peake and Shinseki.
