Challenge to Voting Rights Act of 1965 Oral Arguments

The Supreme Court heard oral arguments in the case of [Northwest Austin Municipal Utility District No. 1 v. Holder]. At issue were provisions of the 1965 federal Voting Rights Act which ban all states from voting discrimination based on "race or color," but targets states and areas with a history of racial discrimination in voting. Currently eight states and parts of eight other states are required to seek permission from the U.S. Justice Department or the federal court in Washington before making changes in the voting process such as changing voting districts, polling locations, or other election procedures.

This program contained the audio recording released by the court immediately after the arguments were presented. Still images of participants were shown on the screen as they spoke. Justice Thomas did not speak.

Book Discussion on [FCC v. Fox Television]

America and the Courts previews the case of [FCC v. Fox Television], scheduled to be argued before the U.S. Supreme Court on November 4, 2008. The Supreme Court would hear oral argument on the Federal Communications Commission's policy of fining broadcasters for isolated television broadcasts of curse words, called "fleeting expletives." The FCC asked the Court to review the case after a lower court invalidated the policy. It would be the first time in 30 years for the Supreme Court to hear a broadcast indecency case. The case stems from two separate broadcasts of the Billboard Music Awards on Fox Television stations. Cher used profanity during the 2002 broadcast and Nicole Richie used profanity in 2003. Video clips of those incidents were shown. Also shown were video clips from the Second Circuit Oral Argument in the [Fox Television v. FCC] case on December 20, 2006, in New York City.

Ted Hearn was interviewed about the case. He reacted to an interview with Carter Phillips, attorney for Fox Television, which was taped at the Sidley Austin Law Office in Washington, D.C., on October 20, 2008. Robert Peters and Robin Bronk participated by telephone.

Private Memorials on Public Land

A coalition of veterans groups talked about their efforts to help protect privately-funded memorials on public land. Liberty Legal Institute had filed an amicus brief on their behalf in the case of [Pleasant Grove City v. Summum] to be heard by the U.S. Supreme Court the next day. Pleasant Grove, Utah, was appealing a 10th Circuit Court of Appeals ruling that the city was violating the First Amendment rights of the Summum religious group by not accepting their monument in a park that already held a monument displaying the Ten Commandments. The veterans groups fear that this precedent would lead to all privately-funded monuments being removed. This would include thousands of veteran and war memorials.
