      <description>The Supreme Court heard oral arguments in the case of [District of Columbia v. Heller], in which a 1976 law was challenged that had the effect of banning handguns in the District of Columbia. The Court will decide the central meaning of the Second Amendment's "right of the people to keep and bear arms," and whether it is an individual right or a right in relation to service in a state militia. Walter Dellinger is a former solicitor general.

      <title>Second Amendment Rights and States</title>
      <description>Participants talked about gun control laws and a Supreme Court case scheduled to be argued the following day.
In 2008, the U.S. Supreme Court, in [District of Columbia v. Heller], struck down Washington, D.C.'s ban on handguns and found that the Second Amendment protects an individual right to keep and bear arms. On March 2, 2010, in [McDonald v. City of Chicago], the Court will hear oral arguments on whether that right applies to states and localities. The Court is expected to hold that it does: a key purpose of the Fourteenth Amendment, ratified at the height of Reconstruction in 1868, was to allow newly freed slaves and white Unionists to defend themselves against Southern reprisals by protecting their right to keep and bear arms. But if the Court reaches that result via the Due Process Clause or the Privileges or Immunities Clause, which was specifically enacted to protect various individual rights, including particularly the right to armed self-defense, would help determine the future of gun rights in America and also constitutional law generally, because it could lead to the re-invigoration of a variety of important liberties that courts have long neglected.</description>

      <title>Guns and Liberty</title>
      <description>Authors talked about the belief that guns are needed to stave off government tyranny. Mr. Horowitz argued that the belief is fundamentally incorrect and that insurrectionists are the real threat to freedom. Then Mr. Churchill talked about libertarian concerns and the origins and growth of the militia movement in the principle that the people must be willing and able to resist tyranny. He also talked about the politics of fear. After remarks made in rebuttal, both authors responded to questions from members of the audience.
Joshua Horowitz is the co-author, with Casey Anderson, of [Guns, Democracy, and the Insurrectionist Idea] (University of Michigan Press; April 29, 2009). Mr. Horowitz is executive director of the Coalition to Stop Gun Violence and the Educational Fund to Stop Gun Violence. An attorney, he was a visiting scholar at the Johns Hopkins Bloomberg School of Public Health. 
Robert Churchill is the author of [To Shake Their Guns in the Tyrant's Face: Libertarian Political Violence and the Origins of the Militia Movement] (University of Michigan Press; March 3, 2009). He is an associate professor of early American history at Hartford University and has published numerous articles on the American Revolution and American political violence.</description>

      <description>Witnesses testified on a proposed assault weapons ban introduced by Senator Dianne Feinstein (D-CA) that would prohibit the sale, transfer, importation and manufacturing of "military-style assault weapons" and high-capacity ammunition magazines. She showed videos of guns as she gave details of the bill. There was tear-filled testimony from residents of Newtown, Connecticut, video, some heated exchanges over both the rights of gun owners and the effectiveness of gun bans, and audience applause. Senator Feinstein, who was chairing the hearing, called for civility.</description>

      <description>Saul Cornell was a guest on WAMU's "Diane Rehm Show" to talk about his book, [A Well-Regulated Militia: The Founding Fathers and the Origins of Gun Control in America], published by Oxford University Press. He talked about the opposing sides of the gun control debate, tracing the history of the different interpretations of the Second Amendment, saying that both sides base their opinions on a flawed understanding of the Amendment. He said that gun rights supporters focus on "the right to bear arms," whereas the gun control proponents look at the preamble, which addresses having a "well-regulated militia."  Prof. Cornell agruded that the 2nd Amendment guarantees neither an individual right nor a right of the state but a civic right to protect the nation, state and community.       <title>[Nordyke v. King] Oral Argument</title>
      <description>The Ninth Circuit Court of Appeals head oral arguments in the case of [Nordyke v. King et al.] in which gun show operators Russell and Sallie Nordyke appealed a ban of firearms from the Alameda County Fairgrounds that did not except gun shows. Mary King was one of the members of the Alamed County Board of Supervisors named in the suite. The plaintiffs contended that the ban violates their First Amendment right of free speech and their Second Amendment right to bear arms, as well as the due process clause as other groups were allowed to have guns on the fairgrounds. The plaintiffs also argued that the individual right to bear arms recognized by the U.S. Supreme Court in [District of Columbia v. Heller] must be recognized by states and not just the federal government under the 14th Amendment.

      <title>Washington, D.C. Gun Control Law</title>
      <description>The panelists discussed the U.S. Supreme Court case, [District of Columbia v. Heller], which concerns the constitutionality of the District of Columbia's ban on the private possession of handguns. Experts from a variety of perspectives discussed whether the Second Amendment protects only militia-related rights or the rights of private individuals, the appropriate standard for reviewing gun control legislation, and the potential legal and policy implications of the first Court decision in this area in 68 years. The Supreme Court is scheduled to hear oral arguments in this case on March 18, 2008. Each of the panelists wrote [amicus curiae] (friend of the Court) briefs in this case. Ms. Lithwick moderated. After their presentations the panelists responded to audience members' questions.
