Proposition 8 Repeal Oral Arguments

The California State Supreme Court heard oral arguments on whether Proposition 8, an anti-gay-marriage ballot initiative which passed in November 2008, should be upheld and, if so, whether the marriages of an estimated 18,000 same-sex couples should remain valid.

The arguments the court heard focused on whether Proposition 8 is invalid because it constitutes a revision of, rather than an amendment to, the California Constitution. If it were an amendment to the Constitution, it could be passed by a state wide referendum as had occurred. If it were a revision, it would require a 2/3 vote in California's bicameral legislature to be passed, which had not occurred. The difference between the two is not clearly articulated in law or court cases in California, but a revision is a substantial change while an amendment is a minor change. The court also heard arguments about the Separation of Powers and the validity of the marriages that occurred before the Proposition was passed.

The case was Strauss v. Horton. Coverage courtesy of the California Channel.

Richard Rayner talked about his book [A Bright and Guilty Place: Murder, Corruption, and L.A.'s Scandalous Coming of Age] (Doubleday; June 23, 2009). In his book Richard Rayner presents a history of Los Angeles in the 1920s by examining the lives of Leslie White, a crime scene investigator, and David H. Clark, a prosecutor in the Los Angeles District Attorney's office. The two men were involved in several of the early "trials of the century" including the St. Francis Dam disaster and the murder of Ned Doheny, son of oil baron, E.L. Doheny who was one of the richest men in the world. But David Clark eventually became a murder suspect himself. Mr. Rayner showed photographs as he talked about how he came to explore the noir character of the city. He held a conversation with David Ulin, and then responded to questions from members of the audience.

"ALOUD at Central Library" was presented Wednesday, July 8, 2009, at 7:00 p.m. PT by the Los Angeles Library Foundation in association with the Los Angeles Public Library.

Retired National Park Service Ranger John Martini presented an illustrated history of the forts that once defended San Francisco from an enemy that never came. Starting with old Fort Point, completed in 1861, he traced the evolving story of the bay's fortifications from the earliest Spanish adobe batteries up through the Civil War and culminated with the nuclear-tipped Nike missiles of the 1970s. He responded to questions from members of the audience at the Fort Mason Conference Center in San Francisco.
"Sentries at the Golden Gate: From the Gold Rush to the Cold War" was a program of the San Francisco Museum and Historical Society marking the sesquicentennial anniversary of the completion of Fort Point.

Book Discussion on [The Age of Gold]

Professor Brands talked about his book, [The Age of Gold: The California Gold Rush and the New American Dream], published by Doubleday. In the book, he tells how such notable figures as John and Jessie Fremont, Leland Stanford and George Hearst amassed their fortunes. He explains that fortunes were also lost by hundreds of prospectors. He reveals how the Gold Rush changed the way Americans viewed the Puritan ethic of hard work, and how the gradual accumulation of worldly riches gave way to the desire of instant wealth. Professor Brands answered questions from the audience following his remarks.

Same-Sex Marriage Oral Arguments

The California State Supreme Court heard oral arguments on whether or not San Francisco Mayor Gavin Newsom and other city officials overstepped their authority and violated state law by issuing marriage licenses to same-sex couples. Those who felt that the local officials had overstepped argued that they had a duty to enforce state laws, and that interpreting laws or declaring them unconstitutional were the province of the state judiciary. Supporters of the mayor claimed that the city administration acted in good faith by refusing to enforce a law they believed was unconstitutional. These cases, [Lockyer v. City and County of San Francisco] and [Lewis v. Alfaro], did not address the question of whether or not a state law limiting marriage to opposite sex couples violated the equal protection clause of the California state constitution.
