Supreme Court Term Review

The panelists gave an overview of the first half of the Supreme Court term, including the key cases that were heard. They described the continuing, substantial increase in criminal cases, with an increase of over 30% for in forma pauperis (unpaid docket) cases. The downward trend in argued cases continues, as two-case argument days have become commonplace. The Court's choices not to hear cases are also as important as the cases they choose to hear. The key cases analyzed included reviewing school desegregation in Oklahoma City schools, overturning Florida's death penalty determination and imposing significant review standards on state appellate courts, overruling Mississippi's custodial interrogation laws, and ruling that trial standards of relevancy do not carry over equally for grand jury investigations.

In the first case, arguments where heard for a First Amendment challenge which questioned whether a journalist had fabricated direct quotes for an article. The subject of the article sued the magazine running the story. The other case involved a decision handed down by the Court on a school busing case in Oklahoma. The Court's decision allows for school districts to discontinue busing policies designed to end segregation, if certain standards of equity can be proven. Mr. Cramer called this case an "opening of the door to back away from social engineering policies."
