Justice Department Prosecutorial Misconduct, Introductory Remarks

Mr. Hurley provided introductory remarks before the panel discussion on the topic of the allegations of political misconduct at the Justice Department during the Bush administration. His remarks were followed by a panel discussion led by Andrew Kreig.

In his remarks he spoke about Sarah McClendon, her participation on the board of a museum for Southern history, and his investigation of efforts by critics of the museum which he said revealed a concerted effort by federal officials to plant informants on neo-Nazi and white supremacists within the museum organization. He said such actions were evidence of a "hidden agenda" espoused by government officials "which no one knows anything about."

The panel discussion that followed is on program 287304-1.

U.S. Attorney Hiring and Dismissals

The House Judiciary Committee held a hearing on the investigation into the firing of the U.S. Attorneys in 2006. Glenn Fine, the Department of Justice Inspector General, in his testimony summarized the findings of a report conducted by his office. Findings of the report included that the process used to remove attorneys was flawed, there are gaps in the investigation because of the refusal of key witnesses to testify, and the evidence used in the report does not establish a violation. As a result of the gaps in testimony, Mr. Fine said the evidence was incomplete and recommended further investigation.

Dismissal of U.S. Attorneys

The House Judiciary Committee held a hearing on the politicizing of the hiring and firing of U.S. attorneys. Members spoke about the dismissals of several U.S. attorneys and Ms. Miers' failure to heed a subpoena issued by the committee.

On July 11 Harriett Miers had announced she would not appear before the subcommittee. President Bush ordered former White House Counsel Harriet Miers not to testify before the House panel investigating U.S. attorney firings. "Ms. Miers has absolute immunity from compelled congressional testimony as to matters occurring while she was a senior adviser to the president," White House Counsel Fred Fielding wrote in a letter to Miers' lawyer, George T. Manning. Manning immediately notified House Judiciary Chairman Conyers that Miers would not appear.

Ms. Goodling testified about her knowledge of plans to dismiss several U.S. attorneys at the Justice Department, the role the White House might have played in the decision, and her duties at the department. After invoking her Fifth Amendment right against self incrimination, she testified under a grant of immunity that she has sometimes "crossed the line" in asking about political affiliations when interviewing and hiring assistant U.S. attorneys and that she was not directly involved in the final decisions on dismissals. She also talked about conversations and meetings with both Assistant Attorney General McNulty and Attorney General Gonzales on the matter and their previous testimony before congressional committees. Her testimony was sometimes interrupted by points of order and parliamentary inquiry made by Republican members who generally objected to the conduct of the hearing.

Fired U.S. Attorneys

Former U.S. attorneys spoke about recent controversy surrounding their termination from the Justice Department. They said that they believed ongoing investigations into the dismissals of eight federal prosecutors could result in criminal charges against senior Justice Department officials. They also said they believed White House political adviser Karl Rove and his aides instigated the dismissals and ultimately decided who among the nation's 93 U.S. attorneys should be fired. Following their remarks they answered questions from the audience.

Justice Department Oversight

Attorney General Gonzales testified about the firing of several U.S. attorneys and Justice Department decision making procedures related to the dismissals, as well as other departmental programs at an oversight hearing on the Justice Department. Members' questions focused on the decision to dismiss the attorneys, possible influence by the White House in the process, and the attorney general's reluctance to specify how a list of U.S. attorneys was generated and how the eventual firing decision was reached at the department. Procedural queries by members were sometimes contentious and members occasionally questioned one another's motives.

Soon after the start of the hearing Chairman Conyers instructed protesters to leave the hearing room.

U.S. Attorney Dismissals

The House Judiciary Commercial and Administrative Law Subcommittee held a hearing on "The Continuing Investigation into the U.S. Attorneys Controversy." Former Deputy Attorney General James Comey was subpoenaed to testify about the firings of eight U.S. attorneys and his role as the Justice Department's second-highest-ranking official when discussions regarding the firings began. He said that he was never informed about an effort by Attorney General Gonzales and his aides to remove a large group of prosecutors that began in early 2005, and found reports of political decisions in hiring of several assistant U.S. attorneys "disturbing."

Representative Emanuel spoke about current issues in politics and government. He was very critical of the Bush administration for the dismissals of several U.S. attorneys and political decision making in military policy in Iraq. He also addressed the implication of several recent news stories about the political decision making of the Bush White House.
Mr. Nivola made introductory remarks and Mr. Mann moderated the questions and answer session.

Dismissal of U.S. Attorneys

Secretary Gonzales testified at an oversight hearing of Justice Department operations in which he was repeatedly questioned about his role in the dismissal of eight U.S. attorneys, his management of the process by which the decision was reached, and the potential political considerations involved in the firings. He apologized for mistakes and poor judgment in responding to criticism for the dismissals, but defended the decision and said that political concerns did not play a role. Several Republican senators, as well as Democratic senators, harshly criticized his judgment and leadership of the Justice Department, with Senator Coburn publicly calling for Mr. Gonzales' resignation.
