Book Discussion on [Abuse of Power: How the Government Misuses Eminent Domain]

Mr. Greenhut talked about his book [Abuse Of Power: How The Government Misuses Eminent Domain], published by Seven Locks Press. In June 2004, his book documented this growing use of local government power to seize property for the use of private developers. A year later, in June 2005, the U.S. Supreme Court ruled in [Kelo v. New London] that local governments may force private property owners to sell to make way for private economic development, even if the property is not blighted. In response, many states have passed legislation and proposed amendments to their state constitutions to block this governmental power over the rights of property owners. Timothy Sandefur submitted a friend-of-the-court brief on behalf of property owners in the Kelo case. In addition, he consulted in the drafting of State Senator Tom McClintock's proposed constitutional amendment to limit eminent domain in California. The panelists discussed the various ways governments have abused the power of eminent domain in the seizure of property from private owners. The discussion ranged from the time of American colonization to the present day, including ways property owners are fighting to protect their rights. The discussion is moderated by David Theroux. After their presentations the panelists answered audience members' questions.

Real Estate Settlement Regulations

Witnesses testified about proposed changes to Real Estate Settlement Procedures Act regulations. Although a number of changes were proposed, the most contentious issue was a rule that would allow mortgage lenders to bundle the loan with mortgage settlement and other services. Supporters of the rule argued that, by permitting lenders to offer a complete mortgage package, the rule would simplify the process for borrowers. Opponents expressed concern that the rule would prevent consumers from searching for the best price on each service, and that packaging services would allow large lenders to drive small mortgage services firms out of business, decreasing competition and ultimately increasing the price paid by consumers. Some witnesses and members of the committee also criticized the rule-making process, claiming that supporting evidence and analysis were lacking and that the secretive nature of the process did not allow adequate public scrutiny and input.
