      <title>Employment Non-Discrimination Act</title>
      <description>Witnesses testified about the proposed Employment Non-Discrimination Act. The legislation to prohibit employers from discriminating against minorities, and would prohibit bias on the basis of sexual orientation or gender identity. Exempt from the bill were the armed services, veterans' service groups, religious organizations and groups with fewer than 15 employees.
In the third panel supporters and opponents of the bill testified about the prevalence of workforce discrimination and possible consequences of enacting  the legislation. Vandy Beth Glenn, who's transgender, her termination after she announced she was transitioning from male to female.</description>

      <title>Use of English in the Workplace</title>
      <description>The U.S. Commission on Civil Rights held a meeting which included presentations on the issue of employers specifying English as the common language of the workplace. Employers argue that it can be necessary in order to ensure a safe workspace free of racial or gender-related issues, to ensure quality and efficiency of work, and for customer relations. The U.S. Equal Employment Opportunity Commission (EEOC) has taken the position that these "English Only" policies frequently violate the law. The presenters responded to questions from the commissioners and staff.
 
 
 
 
 Timothy Riordan is an attorney that has defended a company against claims brought by the EEOC. Richard Kidman is a business owner sued by the EEOC.</description>

      <title>Military Recruiting on Campus</title>
      <description>The guests discussed the Supreme Court case to be heard December 6, 2005, [Rumsfeld v. F.A.I.R.] (Forum for Academic and Institutional Rights), concerning the constitutionality of the Solomon Act as well as John Roberts' views on the issue. The act mandates that institutes of higher education such as colleges and law schools will lose their federal funding if they ban military recruiters. The Solomon Amendment was originally passed in the wake of the 1993 "Don't Ask, Don't Tell" policy when law schools stated that military recruiters would be barred from campuses if the military was discriminatory. They responded to questions and comments from viewers.
 
 Joseph Zengerle is the executive director of the Clinic for Legal Assistance to Servicemembers (CLAS) at George Mason University. He has joined students and other professors from various universities in filing an [amicus curiae] brief in support of the petitioner, Secretary of Defense Rumsfeld.</description>

      <title>Federal Budget for Supreme Court</title>
      <description>Justice Souter and Justice Thomas told the committee that the Supreme Court will take steps to hire more minority law clerks. They both pointed to the number of minorities in the top ranks of major law schools and among clerks for lower-court judges as the main reason for the Supreme Court's poor record. Most clerks are a year out of law school and are recommended by professors or appeals court judges, whom they serve before they come to the high court. Mr. Hantman talked about his budget request for the renovation of the U.S. Supreme Court building.</description>

      <description>Mr. Carter attended Stanford University and Yale University Law School. He discussed the problem of whites opposed to affirmative action being labelled racist, and blacks opposed to affirmative action being seen as "traitors."  He said he wrote the book to promote the benefits of affirmative action and to get rid of the "rhetoric and name-calling."  He said that it is important to open higher educational opportunities to non-whites, but after college or entry-level positions, the need for affirmative action has ended. He cited his own college education as a model of affirmative action.</description>

      <description>Mr. Thomas, chairman of the Equal Employment Opportunity Commission, discussed his work at the federal agency overseeing the enforcement of federal regulations barring sex and race discrimination in the workplace. He discussed the record of the Equal Employment Opportunity Commission and the Reagan administration in preventing race and sex discrimination in the American workplace. Mr. Thomas was later appointed to the D.C. Circuit of the U.S. Court of Appeals in 1990, and was nominated to the Supreme Court by President Bush in 1991.</description>
