150th Anniversary of the Dred Scott Decision

Professor Mark Graber talked about the Dred Scott case and its impact on the law and American history. Archival video clips of current Supreme Court Justices commenting on the Dred Scott case were shown. Mark Graber is the author of [Dred Scott and the Problem of Constitutional Evil], published by Cambridge University Press.

Dred Scott was a slave who lived with his owner in the free state of Illinois and the free territory of Wisconsin before moving back to the slave state of Missouri. He sued in court for his freedom based on his years of living in free states. Dred Scott eventually appealed his case to the U.S. Supreme Court ([Dred Scott v. Sandford]). In March 1857, the Supreme Court, led by Chief Justice Roger B. Taney, declared in a 7-2 decision that all blacks were not and could never become citizens of the United States. The court also declared the 1820 Missouri Compromise unconstitutional, thus permitting slavery in all of the country's territories.

Slave Reparations Case Oral Arguments

The Seventh Circuit Court of Appeals heard oral arguments in [Farmer-Paellmann v. Brown and Williamson], a case involving slavery reparations. The program began with a telephone interview from Chicago with Natasha Korecki talking about the case. The oral arguments were audio only with a still picture of each speaker shown on the screen. Madans and Pell argued against slave reparations. Wareham, Afran, and Ratliff argued in favor of reparations.

This case centers on whether the predecessor companies of J.P. Morgan, Bank of America, and 18 other corporate defendants extended loans to slave owners using slaves as collateral and if the predecessor companies of major insurance agencies, such as Aetna and Lloyds of London, wrote life-insurance policies on the lives of slaves with slave owners as the beneficiaries.

Deadria Farmer-Paellmann was the lead plaintiff in this case seeking to create a trust fund for the descendants of slaves. This case was dismissed by a U.S. District judge earlier in the year. The judge ruled that the plaintiffs had no standing and the statutes of limitation had run out.

Supreme Court Stakeout

Co-counsels for Salim Hamdan spoke to reporters about his appeal to the Supreme Court following oral arguments in [Hamdan v. Rumsfeld].

Salim Ahmed Hamdan, a Yemen native, served as the driver and aide to Osama Bin Laden until he was captured in Afghanistan and subsequently detained at the U.S. Naval Base at Guantanamo Bay, Cuba. He filed a petition of habeas corpus to challenge his confinement. In July 2005 the U.S. Court of Appeals for the District of Columbia ruled against Hamdan, saying Congress had authorized the president to set up special tribunals. The court also ruled that detainees could not appeal based on violations of international treaties, such as the Geneva Conventions.

America and the Courts

America and the Courts included:

On Friday, March 3, 2006 the U.S. Supreme Court class photo was taken.

On Wednesday, February 1, 2006, in Cincinnati, Ohio, the Sixth Circuit Court of Appeals heard oral argument in [Cincinnati Women's Service v. Voinovich]. This case centers on a 1998 law signed by former Ohio Governor George Voinovich that requires women to meet face-to-face with a doctor to discuss the procedure, risks and alternatives to abortion. The law also requires that women under 18 seeking an abortion must get consent from a parent unless she can prove in juvenile court that she is mature enough to make a decision on abortion. The ruling by a U.S. District Judge that the law is constitutional was appealed.

This program contains audio with still images of participants as they spoke.

On Wednesday, March 1, 2006, attorneys spoke to reporters on the steps of the U.S. Supreme Court following oral arguments in four Texas redistricting cases. The Court will decide if a 2003 district map redrawn by the Republican-led legislature is constitutional.

Reading of the George Washington Letter

Supreme Court Justice Ruth Bader Ginsburg talked about her fellow Jewish members of the Supreme Court - Louis Brandeis, Benjamin Cardozo, Felix Frankfurter, Arthur Goldberg, Abe Fortas, and Stephen Breyer.

Justice Ginsburg's speech was the keynote event as members of Newport, Rhode Island's Touro Synagogue read a landmark letter on religious liberty sent to the Touro congregation in 1790 by President George Washington. That year President Washington visited Newport, about a year and a half prior to the ratification of the Bill of Rights. In response to a letter from Touro's Moses Seixas, welcoming Washington to the city and at the same time seeking an assurance of religious freedom, Washington wrote that the new U.S. government "gives to bigotry no sanction, to persecution no assistance."

Touro's Washington letter reading this year coincides with wider events marking 350 years of Jewish life in America. The first Jews in colonial America landed at New York Harbor in 1654; Newport's first Jewish congregation arrived in 1658. Touro Synagogue is the oldest Jewish house of worship in the United States.

America and the Courts

America and the Courts featured several events:

On Sunday September 14, former Solicitor General Charles Fried addressed a Hofstra University conference on judicial ethics. Mr. Fried talked about his views on the subject, including the "aura" surrounding judges, and the differences between judicial ethics and the professional ethics of other occupations. In Mr. Fried's view, the primary expectations of judges are that they know the law and render judgment according to the law. He strongly criticized judges who attempt to serve justice by twisting or ignoring the law. Following prepared remarks, he responded to questions from the audience.

Following Judge Fried, two short speeches by U.S. Supreme Court Chief Justice Rehnquist were shown.

On Wednesday September 17, Chief Justice Rehnquist spoke at the rededication of the National Archives rotunda. He stressed the important role of a strong and independent judiciary in protecting individual liberties. He also talked about a letter, written by William Howard Taft, which was placed in a time capsule in 1926. On Thursday December 11, the chief justice spoke at the dedication of the Udvar-Hazy Center at the National Air and Space Museum. Chief Justice Rehnquist, who served as chancellor of the Smithsonian Institution, talked about the new additions to the National Air and Space Museum and the value of the museum to America.

Justice Kennedy spoke to members of the American Bar Association about his initiative to lead discussions with high school students about American democracy and civic values after September 11, 2001 terrorist attacks. Titled "Dialogue on Freedom," the new program will be carried out by the association to mobilize judges and lawyers to go to American high schools to lead these discussions.

[Flowers v. Carville]

Oral arguments were heard before the 9th U.S. Circuit Court of Appeals in the case [Flowers v. Carville]. The case brought by Gennifer Flowers charges James Carville, George
Stephanopoulos and Little, Brown & Company with defamation and false light. These charges stem from statements published on CNN's "Larry King Live"
program in January and February of 1998 and statements in a book authored by
Stephanopoulos. Former first lady Hillary Rodham Clinton is also named in
the defamation lawsuit. The lower court dismissed the defamation lawsuit
(filed on Flowers behalf by Judicial Watch) in November 2000, because the
U.S. District Court in Las Vegas, Nevada ruled the case had passed the
statute of limitations. The complaint is seeking monetary damages from the
defendants and costs of attorney's fees.
